5) Charging Improper Fees – If you’ve been charged fees you don’t owe, you might also have a claim. In 2021 a small claims court case was submitted against American Home Shield. However, this case is pending with no court documents available to the public yet. AHS work together with Airtech air condition co. to fraud me. There has been no solution to to this problem and I an out 9,000.00 and counting. Well, you’ll want to think about it for a second.
They kept sending out an a/c guy that never fixed the unit. AFTER multiple visits in one week SUDDENLY the unit freezes up and now has leaked refrigerant out and they want me to pay $1200 for coil replacement (over $500 for the refrigerant.) and the rest bogus "code violations". PLUS they are trying to collect another $75 service call fee that multiple reps have said is an error and are going to correct. They act in bad faith and should be stopped.
Ready to start your claim against American Home Shield? Submitting a claim takes only 10 minutes or less:
Similar lawsuits against other home warranty companies are reportedly pending. Home warranty companies and realty associations say the warranties are not settlement services and are therefore not in violation of the Real Estate Settlement Procedures Act. I've had AHS and they are the worst, they denied coverages that were clearly printed in black and white in the contract. I am an insurance agent and I told the company that partnered with AHS that I would never ever sell one of my clients one of these garbage policies, since 2004 I have never sold one. @Texas -- some of the issues you had weren't from AHS but from the contractors. Anyone not wanting to go up in to the attic is not an AHS issue.
The blame game and blatant fraud never ends with AHS. I also filed a small claims case and hearing is upcoming shortly. A lot of companies like American Home Shield add what’s called an arbitration clause to their contracts. It gives them the right to force legal claims out of state or federal courts. But you still have rights to sue American Home Shield. In the meantime, consumers of other home warranty companies have filed lawsuits of their own or may be looking into possible lawsuits, suspecting that their claims were denied improperly.
broker compensation, RESPA issues
Their contractors have just been replacing them instead of resolving the root cause. Never the same technician and rarely ever the same contractor so there is zero continuity in the service they provide and now they are refusing to replace by HVAC unit. Home warranty firms in Texas generally paid their contractors on a per-claim basis.
It seems they just keep pushing repairs back until your insurance is up or you give up, take care of it yourself, and then they won't reimburse you. Over two months now with refrigerant leaking in my house, literally dozens of calls, hours of time on hold, and nothing has actually been done other than a little refrigerant added just to leak back out. They charged me for a service fee for refrigerator company that never came into the house.
Can I sue American Home Shield?
I think it's terrible -- but that's just me. Class action lawsuits listed in the news not just with American Home Shield but with other large corporations. Class action lawsuits are lawsuits where hundreds or thousands of consumers or customers all have the same complaint against a company so they all get represented through one lawsuit rather than each filing multiple lawsuits. As part of the agreement, AHS decided to set up a review desk to reflect on claims from settlement class members whose claims were declined during the class period.
The Armstrongs claim that the 1995 “average contract cost” should have been compiled from all of AHS's Texas pool/spa contracts. I've been requesting services on my heat pump since 2004 nearly every year to-date. AHS has provided only enough assistance to keep the unit working. Now that the heat pump needs to be replaced, they are accusing me of failing to provide maintenance and has denied my request for a replacement pump. The unit is literally falling apart because they only would send techs out who agreed to do the bare minimum to keep it running and no more.
You may be wondering how can you possibly be a class action lawsuit plaintiff if you live in New York City?
Ahs totes sucks …June called for service and paid…ac not fixed…Sept still on hold listening to apologies. The best way to achieve just that is to hire an experienced personal injury attorney. These lawyers understand how to navigate the court system and win for their clients.
AirNow returned but they needed to do an assessment and resubmit the information to AHS for approval. Contractor says leaking from sink is not covered. The real issue is the contractor does not submit paperwork to AHS to determine the issue.

Now part 2--I called again AHS after few days about my AIR CONDITIONING, someone came and checked and I also gave him $75 copay. Now they are saying AHS does not cover this service. I was so Frustrated kept calling them and finally they said I have to pay around few hundred dollars to repair that, I don't remember the exact amount but it was over $400. About 3 or 4 years ago, we had insulation sprayed into our attic, and some ended up in an A/C drain pipe which began to leak.
Sometimes, American Home Shield will not show up to oppose you. If that happens, take advantage of the situation to focus on your side of the story.
